operates this web site. All references to "we", "us", "this web site"
or "this site" shall be construed to mean CodeSourcery. CodeSourcery
understands that visitors to this web site are concerned about the
privacy of information. The following describes our privacy policy,
including our policy regarding information that we collect through
this web site.

A "cookie" is a bit of information that a Web site sends to

An Internet Protocol (IP) address is a number assigned to your
computer by your Internet service provider so you can access
the Internet and is generally considered to be non-personally
identifiable information, because in most cases an IP address
is dynamic (changing each time you connect to the Internet),
rather than static (unique to a particular user's
computer). The IP address can be used to diagnose problems
with a server, report aggregate information, determine the
fastest route for your computer to use in connecting to a
site, and administer and improve the site.

"Internet tags" (also known as Web Beacons, single-pixel GIFs,
clear GIFs, invisible GIFs, and 1-by-1 GIFs) are smaller than
cookies and tell the Web site server information such as the
IP address and browser type related to the visitor's
computer. Tags may be placed both on online advertisements
that bring people to the site and on different pages of the
site. Such tags indicate how many times a page is opened and
which information is consulted.

"Navigational data" (log files, server logs, and clickstream

Use and Sharing of Passive Information. This site may use,
combine, and share such passively collected anonymous information to

Collection of Personally Identifiable Information ("PII").
We will ask you when we need information that personally identifies
you or allows us to contact you (which re refer to as "PII"). PII
which we collect may vary depending on the benefits and/or services
you select, and may include one or more of the following categories
of information: name, physical address, an email address, phone
number, and credit card information including credit card number,
expiration date, and billing address. WE DO NOT STORE CREDIT CARD
INFORMATION ON OUR SITE.
Use And Sharing of PII: General Policy. Except as discussed
below, our general policy is that we will use your PII only for the
performance of the services or transaction for which it was given,
and we will not share, sell, or rent your PII to others. The only
exceptions to this general policy are (i) if this privacy policy
explicitly provides otherwise, and (ii) if explicitly approved by you
through our site. WE WILL NEVER UNDER ANY CIRCUMSTANCES COMBINE
PASSIVELY COLLECTED INFORMATION WITH YOUR PII.
Sharing of PII: Affiliates. Unless prohibited by law, we may
use and share PII within any companies that may legally affiliated
with us (such as, for example, any parent, subsidiary, or brother or
sister entity) for purposes of providing service and account
maintenance, to help us design and improve products and services, and
to offer products and services that may be of interest to you.
Sharing of PII: Third-Party Service Providers. We may hire
other companies to provide services on our behalf. These third-party
service providers may include, for example, companies that (i) host,
manage, and service our website, web servers, software and systems,
(ii) provide business or data processing services, (iii) provide
marketing services, (iv) provide payment processing, fulfillment,
and/or shipping services, (i) refer you to this site in their
capacity as our marketing partner or affiliate, and (vi) provide
other new services. We may share or make PII accessible to such
third parties; however, all such third parties are required to
maintain the confidentiality of PII and are prohibited from using PII
for any purpose other than for the services they provide, which may
include emails, but only to the extent email is integral to their
services.
Sharing of PII: Purchase or Sale of Businesses. We
continually look for ways to improve our business. One such way of
improving our business might be to buy or sell a company. If we buy
or sell a business, databases containing PII will likely be
transferred as part of the sale. If we buy a business, we will honor
the requests of that business' former customers regarding their
personally identifiable information. If in connection with a sale
there will be material changes to the way personally identifiable
information is being used, affected consumers will be notified via
e-mail and will be given the opportunity to opt-out.
Sharing of PII: Legal Process. We reserve the right to share
PII with third parties in response to a subpoena, to prevent fraud,
to comply with an inquiry by a government agency or other regulator,
or as necessary for other legal purposes.
Onward Transfer of PII Outside Your Country of Residence. By
providing PII to our site, you acknowledge that our site operates in
the United States, and further you agree to (i) permit our site to
transmit and use your PII anywhere necessary, including across
international boundaries, to affect the services and transactions
provided by this site; and (ii) that such use will be subject to the
terms and conditions stated in this privacy policy.
European Union Privacy Laws; Safe Harbor. The European Union
("EU") maintains strict privacy laws. These rules differ
significantly from United States laws. To reconcile these
differences, the US and the EU have created a Safe Harbor that

Security of PII. We follow generally accepted industry
standards to protect your PII and other sensitive information.
Unfortunately, no data transmission over the Internet or method of
data storage can be guaranteed 100% secure. Therefore, while we
strive to protect your personal information by following generally
accepted industry standards, we cannot ensure or warrant the absolute
security of any information you transmit to us or store at this site.
Requesting Changes To PII. Registered users may make changes
to their PII by following these instructions: Send an email to

used to register with this site and specifying the changes you wish
CodeSourcery to make to the PII stored at this site.
Email From This Site; Opt-Out Rights. If you supply us with
your e-mail address you may receive periodic messages from us with
information specific to the site and required for the normal
functioning of the site as well as for new products or services or
upcoming events. If you prefer not to receive periodic email
messages, you may opt-out as follows: make changes as you would for
PII as provided above.
Links To Business Partner Sites. This website may contain
links to other websites with whom we have a business relationship.
The privacy practices of these websites are not covered by our
privacy policy, and we are not responsible for the privacy practices
or the content of these sites. Additionally, if you register with
any of these sites for any purpose or purchase from any of these
sites, any information that you provide in the process of
registration or purchase, such as your credit card number and other
PII, will be transferred to these sites. These sites have separate
data collection, data privacy, and data security policies and
practices, and we have no responsibility or liability for these
independent policies and practices. You should be careful to review
any privacy policies posted on any of these sites before providing
information to them.
Third-Party Ad Servers. We may use third-party advertising
companies and advertising networks to serve advertisements for this
site. These third-party advertising companies and advertising
networks may use information (not including your PII) about your
visits to this site and other sites in order to provide
advertisements of interest to you. Use of their cookies is not
covered by our privacy policy, and we are not responsible for the
privacy practices or the content of these sites.
Children's Online Policy. We are committed to preserving
online privacy for all of its website visitors, including
children. This site is a general audience site. Consistent with the
Children's Online Privacy Protection Act (COPPA), we will not
knowingly collect any information from, or sell to, children under
the age of 13. If you are a parent or guardian who has discovered
that your child under the age of 13 has submitted his or her

ECPA Notice. This web site treats email messages and other
communications through this site as private. Exceptions are those

Privacy Act of 1986, 18 U.S.C. Sections 2701-2711 (the "ECPA"). The
ECPA permits our limited ability to intercept and/or disclose

USA Patriot Act Notice. The federal USA Patriot Act ("USA
Patriot Act") provides generally for the operator of a communication

obligations, and availing ourselves of all our rights, under the USA
Patriot Act.
Arbitration. All disputes, controversies, or claims arising out of or
relating to this Privacy Policy or CodeSourcery's collection or
use of your PII shall be submitted to and finally resolved by
arbitration under the rules of the American Arbitration Association
("AAA") then in effect. There shall be one arbitrator, and
such arbitrator shall be chosen by mutual agreement of the parties in
accordance with AAA rules. The arbitration shall take place in
Granite Bay, California, and may be conducted by telephone or online.
The arbitrator shall apply the laws of the State of California, USA
to all issues in dispute. The controversy or claim shall be
arbitrated on an individual basis, and shall not be consolidated in
any arbitration with any claim or controversy of any other party.
The findings of the arbitrator shall be final and binding on the
parties, and may be entered in any court of competent jurisdiction
for enforcement.
